Pesticide Management in China
1. Pesticide regulation 《Pesticide Management Regulations, Amendment 2017》
2. Pesticide administration department The pesticide registration and evaluation committee established by the competent agricultural department under the State Council shall be responsible for the pesticide registration and evaluation.
The pesticide registration and evaluation committee is composed of the following personnel:
(1) Experts in the chemistry, efficacy, toxicology, residue, quality standards and testing of pesticide products recommended by the relevant departments of agriculture, forestry, public health, environmental protection, administration of grain and industrial sectors, supervision and administration of production safety, and supply and marketing cooperatives under the state council;
(2) Experts from the National Committee of Experts on Food Safety Risk Assessment;
(3) Representatives of departments of agriculture, forestry, health, environmental protection, grain, industrial management, safety in production supervision and management under the State Council, and general supply and marketing cooperatives.
Rules for pesticide registration and evaluation shall be formulated by the competent agricultural department under the State Council.
3. Registration procedure
When applying for the registration of pesticides, registration tests shall be carried out. The registration tests of new pesticides shall be submitted to the competent agricultural department under the State Council. The competent agricultural department under the State Council shall examine the safety risks and preventive measures of the test within 40 working days from the date of accepting the application. If the test meets the requirements, the registration test shall be permitted; if the test fails to meets the requirements, the applicant shall be notified in writing and the reasons given.
After the registration test is completed, the applicant shall submit an application for pesticide registration to the competent agricultural authorities of the people's governments of the provinces, autonomous regions and municipalities directly under the Central Government, and submit the application data such as the registration test report, the label sample sheet, the quality standard of pesticide products and the inspection method, etc. When applying for registration of new pesticides, standard pesticides shall also be provided. The competent agricultural departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall, within 20 working days from the date of acceptance, submit their opinions on the preliminary examination and submit them to the competent agricultural units under the State Council.
After accepting the application or receiving the application materials submitted by the competent agricultural authorities of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government, the competent agricultural department under the State Council shall organize the examination and grade evaluation, and make the evaluation decision within 20 working days from the date of receiving the evaluation opinions. If it meets the requirements, it shall issue a registration certificate for pesticides; if it fails to meet the requirements, it shall notify the applicant in writing and explain the reasons.
A pesticide registration certificate shall state the name, dosage form, active ingredients and their contents, toxicity, scope of use, method of use and dosage, registration certificate holder, registration certificate number and validity period, etc.
The pesticide registration certificate is valid for 5 years. If the holder of pesticide registration certificate needs to continue to produce pesticides or export pesticides to China upon the expiration of the validity period, he/she shall apply to the competent agricultural department under the state council for extension 90 days before the expiration of the validity period.
If the items specified in the pesticide registration certificate have changed, the holder of the pesticide registration certificate shall change the pesticide registration certificate in accordance with the provisions of the competent department of pesticides under the State Council. |
